WHAT ARE THE criminal ASSAULT CHARGES IN ALASKA?

In Alaska, assault charges are classified in 4 degrees depending upon severity. Assault in the first, second, and third degree are each charged as Class A, B, or C felonies respectively. Assault in the fourth degree is charged as a Class A misdemeanor.

Typically the State considers filing Assault charges when someone has been intentionally or recklessly injured or placed in fear of being injured. What type of assault will be filed will depend on whether the alleged conduct is reckless or intentional, the severity of the injury, if there is one, or whether or not a weapon was used.

WHAT ARE THE PENALTIES FOR ASSAULT?

The penalties for an assault conviction often include:

  • Fourth-Degree: Up to 1-year in jail & fines up to $10,000 (misdemeanor)
  • Third-Degree: Up to 5-years in prison & fines up to $50,000 (felony)
  • Second-Degree: Up to 10-years in prison & fines up to $100,000 (felony)
  • First-Degree: Up to 20-years in prison & fines up to $250,000 (serious felony)

If convicted the court could also require the defendant pay restitution.
